Terms of Service

Effective date: July 26, 2026. Last updated: July 26, 2026. These Terms govern your use of Pulser and related services.

Not financial advice: Pulser is an analytics and data-visualization tool. We are not a broker-dealer, investment advisor, financial advisor, or money manager, and we are not registered with the SEC, FINRA, or any state securities regulator. We do not execute trades, do not custody customer funds or securities, and do not make personalized investment recommendations. All content is for informational purposes only. Investing in equities involves risk, including loss of principal. Past performance is not indicative of future results. Consult a licensed financial professional before making investment decisions.

1. Agreement to these terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and Pulser ("we", "us") governing your use of the website at usepulser.com and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service.

2. What the Service is — and what it isn't

The Service provides interactive charts, fundamental financial data, valuation tools, portfolio tracking, backtesting, and related analytics for publicly listed equities. Market data is sourced from licensed third-party providers and is presented "as is" for informational purposes only.

The Service is not:

  • a brokerage account, trading venue, or order-routing system;
  • investment advice, financial advice, tax advice, or legal advice;
  • a recommendation to buy, sell, or hold any security;
  • a custodian of customer funds, securities, or crypto-assets;
  • a robo-advisor or automated trading system.

We do not know your personal financial situation, risk tolerance, or investment objectives. Nothing on the Service is tailored to your circumstances.

3. Eligibility and account

The Service is not directed at children under 13, consistent with the Children's Online Privacy Protection Act (COPPA), and we do not knowingly permit anyone under 13 to create an account. You must be at least 18 years old, and capable of forming a binding contract under the laws of your state, to create an account or subscribe to a paid plan. You agree to provide accurate information at sign-up and to keep your password confidential. You are responsible for all activity under your account.

We reserve the right to refuse service or terminate accounts at our discretion, in particular for breach of these Terms, fraud, or abuse.

4. Subscription plans, billing, and renewals

  • Plans: We offer a Free plan and paid plans (Plus, Pro) billed monthly or annually. Current prices are shown on usepulser.com/pricing. Prices are in U.S. dollars and exclude any applicable sales, use, or similar transaction taxes, which may be added at checkout depending on your location.
  • Payment processor: All payments are processed by Stripe, Inc. By subscribing, you also accept Stripe's end-user terms.
  • Auto-renewal: Subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current price. Before your first renewal and any renewal at a higher price, we will send the notice required by applicable state automatic-renewal laws. You can cancel at any time from your account settings — your access continues until the end of the current paid period.
  • Price changes: We may change prices for future billing periods. We will notify you by email at least 30 days before any price change. You can cancel before the new price takes effect.
  • Failed payments: If a payment fails, Stripe will retry for up to 14 days. If payment remains unsuccessful, your account is downgraded to the Free plan.

5. Refunds

Except where required by law, fees already paid are non-refundable and we do not provide refunds or credits for partial subscription periods. You can cancel auto-renewal at any time; cancellation stops future charges but does not refund amounts already billed.

We may offer pro-rated refunds at our discretion for service outages exceeding 24 consecutive hours or for billing errors on our part. If you're enrolled in a subscription through a state with an automatic-renewal or "free-to-pay" conversion law (for example, California's Automatic Renewal Law), and you did not receive the notice that law requires, contact us and we will make it right. To request a refund, contact contact@usepulser.com.

6. Acceptable use

You agree not to:

  • share or resell your account credentials;
  • scrape, crawl, or otherwise extract data in bulk via automated means;
  • circumvent plan limits, rate limits, or feature gates (e.g. by direct API calls);
  • reverse-engineer or attempt to extract source code, except as permitted by law;
  • use the Service to violate any applicable law or third-party right;
  • upload malware, attempt intrusion, or interfere with the Service's operation;
  • resell, sublicense, or commercially exploit the Service or its data feeds without our written consent.

We monitor for abuse and may suspend or terminate accounts that violate this section.

7. Intellectual property

The Service, including its design, code, content, and trademarks, is owned by Pulser and protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own informational use, subject to these Terms.

Market data, financial statements, and other third-party data are the property of their respective owners (our market data providers, the exchanges, and the issuers). You may not redistribute this data.

Anything you create using the Service (portfolios, watchlists, notes) remains yours. You grant us a limited license to host, process, and display it only to provide the Service to you.

8. Data accuracy

We do our best to display accurate market data, but we cannot guarantee that it is current, complete, or error-free. Prices may be delayed, financial statements may be revised by the issuer, and fundamental data may be reclassified by our data provider after publication. Always verify critical figures against the company's official filings before acting on them.

The Service may be unavailable from time to time for maintenance, upgrades, or due to issues outside our control (third-party outages, network failures). We do not commit to a specific uptime.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT THE SERVICE OR ANY DATA IT DISPLAYS WILL MEET YOUR INVESTMENT OBJECTIVES OR PRODUCE ANY PARTICULAR FINANCIAL OUTCOME.

Some states do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. This section does not exclude or limit any liability that cannot be excluded or limited under applicable law.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST INVESTMENT RETURNS, OR TRADING LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms excludes or limits our liability for (i) death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any other liability that cannot be excluded or limited under applicable law. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

11. Termination

You may cancel your subscription or delete your account at any time from your account settings. We may suspend or terminate your account if you breach these Terms, attempt to defraud us, or use the Service in a manner that poses risk or legal exposure to us or other users.

On termination, your right to use the Service ends immediately. Data retention after termination is described in our Privacy Policy.

12. Changes to the Service or Terms

We may modify, suspend, or discontinue features at any time. For material changes that adversely affect paid subscribers, we will provide at least 30 days' notice and a pro-rated refund of any prepaid amounts for the affected portion.

We may update these Terms. We will notify you by email of material changes at least 14 days before they take effect. Continued use of the Service after that date means you accept the updated Terms.

13. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, and without regard to the United Nations Convention on Contracts for the International Sale of Goods.

Agreement to arbitrate. You and Pulser agree to resolve any dispute arising out of or relating to these Terms or the Service through final and binding arbitration, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules and will take place, or be conducted by phone/video/written submission, at your election.

No class actions. You and Pulser agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may be brought in court, and the rest of this arbitration agreement remains in effect.

Opt-out. You may opt out of this arbitration agreement by emailing contact@usepulser.com within 30 days of first agreeing to these Terms, stating your name and that you opt out of arbitration. If you opt out, or for any dispute not subject to arbitration, the state and federal courts located in Delaware will have exclusive jurisdiction, and you and Pulser each consent to personal jurisdiction there.
